Ground Lease/Long Lease

Ground leases and long leases have been used in the past by local authorities to maintain control over property and ensure they retain any uplift in value resulting from a change in planning use.  Where such leases are used the transaction will not, however, constitute transfer of title. The use of such leases to maintain control of the property can be fundamentally at odds with the principle of community empowerment particularly if the lease does not allow the community organisation to assign its interest in the property to anyone else.
